Welcome to our website. These Terms and Conditions ("Terms") govern your use of our website and the purchase of any custom products or crafts from Purple Niche, LLC ("we," "us," or "our"). By accessing our site or placing an order, you agree to be bound by these Terms.

1. Custom Orders, Payments, & Design Approvals

Production Prerequisite: Production processing does not begin when an order is placed. Manufacturing officially starts only after the custom invoice/balance is paid in full (or the agreed-upon 50% deposit is successfully processed) and the digital art proof is formally approved by the customer through our designated digital proofing channels or email.
Accuracy Warning: Your approval acts as a final confirmation of layout, spelling, color, and design. We are not responsible for typos, layout preferences, or formatting errors that were visible on the proof after you have signed off and payment has been made.

2. Intellectual Property & Customer Submissions

Artwork Ownership: By uploading or submitting text, photos, graphics, or logos for custom manufacturing, you warrant that you own or have explicit legal permission to use those assets. We do not verify ownership of client-provided files.
Indemnification: You agree to indemnify, defend, and hold harmless Purple Niche, LLC from any legal claims, copyright lawsuits, damages, or fees arising from our use of imagery or text provided by you. We reserve the right to refuse any order that clearly violates a third party’s intellectual property or contains profane material.
Our Designs: All custom designs, patterns, templates, and digital layouts created by us remain the exclusive property of Purple Niche, LLC.

3. Payments, Billing, and Price Errors

Payment Authorization: By submitting a credit card, debit card, or other digital payment method at checkout, you warrant that you are authorized to use that payment account. You authorize Purple Niche LLC to charge the full amount of your order, including shipping and applicable Texas or out-of-state sales taxes.
Processing Fees: All payments are processed through secure third-party payment gateways. We are not responsible for bank holds, overdraft fees, or processing rules charged by your financial institution.
Pricing Corrections: In the event that a product is mistakenly listed at an incorrect price due to a system glitch or typographical error, we reserve the right to refuse or cancel any orders placed for the product listed at the incorrect price. If your payment has already been processed, we will issue a full refund and cancel the order.
Deposit Terms: If a fifty percent (50%) deposit is agreed upon to initiate a custom order, this deposit is strictly non-refundable as it immediately goes toward purchasing specialized raw materials for your project. The final remaining fifty percent (50%) balance must be paid in full prior to the final shipment or local handover of the product.
Bulk Quantity Discounts: We offer tiered bulk discounts on select qualifying items purchased in a single transaction. The discount structure is applied automatically or via manual invoice as follows: 5–9 units (5% off), 10–24 units (10% off), 25–74 units (20% off), and 75+ units (25% off). We reserve the right to exclude specific complex, high-labor, or specialty custom products from bulk discount tiers at our sole discretion. Bulk discounts cannot be combined with other promotional codes or prior offers.

4. Shipping & Risk of Loss

Carrier Delivery: All online orders are shipped via third-party carriers. The risk of loss and title for your purchase pass to you the moment we hand the package over to the carrier. We are not liable for shipping carrier delays, weather damage, or theft after delivery.

5. Strict Refund and Return Policy

All Sales Final: Due to the deeply personalized nature of custom goods, all sales are final. We do not accept returns, cancellations, or exchanges if you change your mind.
Exceptions: We will only offer a replacement or correction if your item contains a manufacturing error or arrives damaged. 6. Electronic Communications

Consent to Digital Terms: By visiting our website, filling out forms, or sending emails to us, you are communicating with us electronically. You consent to receive communications from us electronically, including via email, website notifications, or Google Drive/Adobe Sign comments.
Legal Validity: You agree that all agreements, notices, disclosures, art proof approvals, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

7. Limitation of Liability

To the maximum extent permitted by Texas law, Purple Niche, LLC and its members shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products. Our maximum liability to you for any order shall not exceed the total dollar amount you paid for that specific order.

8. Governing Law

These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
